These Terms and Conditions (the "Terms") govern your access to and use of this Site, operated by Power Peptides LLC ("Power Peptides", "we", "us" or "our"). By accessing and using this Site, you (“Buyer”) agree to be bound by these Terms. If you do not agree with any part of these Terms, you must discontinue immediately.

1. Use of Site and Products

1.1 Intended Use. 

The Products offered for sale on this Site are intended for legitimate research and development purposes only. They are not intended for human or animal consumption, use as a drug, food drugs, food additives, cosmetics, or household application of any kind. Power Peptides disclaims all liability for misuse and provides no instructions for usage. The Products are not intended to diagnose, cure, mitigate, treat or prevent any disease.

1.2 Age Restriction.

You must be at least 21 years old to access and/or purchase from this Site. By doing so, you represent and warrant that you are at least 21 years old.

1.3 Compliance with Laws.

You are responsible for ensuring compliance with all local, state, and federal laws concerning the purchase, handling, storage, and use of the Products. Power Peptides is not liable for any damages caused by the misuse of the products.

1.4 No Resale.

Products sold on this Site are for the Buyer's own research use only. Any resale or transfer of the products to third parties is strictly prohibited.

1.5 Toxic Substances Control Act.

Buyer is solely responsible for ensuring that the products purchased from Power Peptides are approved for use under the Toxic Substances Control Act (TSCA), where applicable.

1.6 Product Verification.

If the Products purchased from Power Peptides are repackaged, relabeled, or used as starting material or components of other products, the Buyer agrees to verify Power Peptides' assay results independently. Power Peptides assumes no liability for any downstream misuse, injury, or consequences incurred by the Buyer or third-party users.

2. Orders and Payment

2.1 Import Tax Disclaimer: For Customers Outside the United States

Please be aware that deliveries to countries outside the United States may incur additional charges including, but not limited to import duties and related fees. These charges are not included in our pricing and are not covered by Power Peptides. If the shipping company or customs authorities require payment of customs taxes or duty fees, you, as the recipient, will be responsible for paying these amounts. We recommend familiarizing yourself with your country's import regulations and potential additional costs before placing an order.

2.2 Accepted Payment Methods. 

• Credit card & debit card

• Mobile wallets like Venmo, Cash App, Apple Pay and Google Pay, 

• e-Check, ACH, Direct Debit, and cryptocurrencies. For e-check/ACH payments, you authorize Power Peptides to electronically debit your account for the amount of your order.

2.3 Prices and Currencies.

Product prices are listed in U.S. Dollars and other currencies based on your region. Prices are subject to change at any time. The Buyer is responsible for any applicable sales tax, import duties, and fees.

2.4 Order Acceptance.

Your order is not accepted until Power Peptides sends an order confirmation. Power Peptides reserves the right to refuse any order in its sole discretion.

2.5 Shipping.

Products are shipped by FedEx whenever possible. Buyer is responsible for shipping costs unless specified. Power Peptides is not liable for shipping delays or damage that occurs during shipping.

3. Returns and Refunds

3.1 No Returns.

Due to the nature of the products sold on this Site, Power Peptides does not accept any returns under any circumstances. All purchases made through this Site are considered final and non-refundable or modifiable unless a purchase cannot be fulfilled. Power Peptides encourages all customers to review their orders carefully before completing a purchase.

4. Intellectual Property

4.1 Ownership.  

The Site and its entire contents, features and functionality, including but not limited to all information, software, code, text, displays, graphics, photographs, video, audio, design, presentation, selection and arrangement, are owned by Power Peptides, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

4.2 Limited License.

You are granted a limited, non-transferable, non-exclusive, revocable license to access and use the Site for research-related purposes only. You may not copy, modify, distribute, or create derivative works from the Site content without written consent.

5. Third-party Content

This Site may include links to third-party websites. Power Peptides is not responsible for the content, policies, or availability of these external sites and disclaims all liability from their use.

6. Indemnity Waiver for Research Compounds

6.1 Waiver Agreement

In consideration of the purchase of research compounds from Power Peptides, I, the undersigned Buyer agree to indemnify, defend, and hold harmless Power Peptides, its officers, directors, contractors, employees, agents, and affiliates (hereinafter referred to as "Merchant") from any and all claims, liabilities, losses, damages, costs, and expenses, including reasonable attorneys' fees, arising from or related to the purchase, possession, or use of the research compounds.

I understand and acknowledge that the research compounds sold by Power Peptides are intended solely for research purposes and are not approved by the U.S. Food and Drug Administration (FDA) for human or animal use. I agree to use the compounds according to all applicable laws and regulations and take full responsibility for any risks associated with their purchase, possession, and use.

I release, discharge, and waive any claims, demands, causes of action, suits, judgments, and liabilities of any kind that may arise from or be connected to the purchase, possession, or use of the research compounds.

I further agree to defend, indemnify, and hold harmless Power Peptides against any claims, liabilities, damages, expenses, and losses, including but not limited to personal injury, property damage, or any other harm, whether direct or indirect, foreseeable or unforeseeable, resulting from or connected to the purchase, possession, or use of the research compounds.

This indemnity waiver applies to me, my affiliates, agents, my heirs, executors, administrators, successors, and assigns.

By purchasing research compounds from Power Peptides, I confirm that I have read and understood this Indemnity Waiver. I voluntarily agree to its terms and conditions.

6.2  Prohibited Conduct. 

Buyer agrees that they may not post, review, or publicly attack Power Peptides with any false information about Power Peptides' products.

7. Disclaimer

DISCLAIMERS YOUR USE OF THE SITE, ITS CONTENT AND ANY PRODUCTS OBTAINED THROUGH THE SITE IS AT YOUR OWN RISK. THE SITE, ITS CONTENT AND ANY PRODUCTS OBTAINED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER POWER PEPTIDES NOR ANY PERSON ASSOCIATED WITH POWER PEPTIDES MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY OR AVAILABILITY OF THE SITE OR USE OF THE PRODUCTS. WITHOUT LIMITING THE FOREGOING, NEITHER POWER PEPTIDES NOR ANYONE ASSOCIATED WITH POWER PEPTIDES REPRESENTS OR WARRANTS THAT THE SITE, ITS CONTENT OR ANY PRODUCTS OBTAINED THROUGH THE SITE WILL BE ACCURATE, RELIABLE, ERROR-FREE OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS OR THAT THE SITE OR ANY PRODUCTS OBTAINED THROUGH THE SITE WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

TO THE FULLEST EXTENT PROVIDED BY LAW, POWER PEPTIDES HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT AND FITNESS FOR PARTICULAR PURPOSE.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

7.1 LIMITATION OF LIABILITY.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

8. Governing Law and Jurisdiction

8.1 Governing Law.

 All matters relating to the Site and these Terms and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Wyoming without giving effect to any choice or conflict of law provision or rule.

8.2 Jurisdiction.

 Any legal suit, action or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the courts of Sheridan County, Wyoming, although we retain the right to bring any suit, action or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

8.3 Legal Expenses.

In the event of any legal dispute, the Buyer agrees to pay or promptly reimburse all of Power Peptides' expenses relating to attorney's fees, filing fees, and any other expenses in relation to the case.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. It's your responsibility to monitor changes to this Terms and Conditions.

By continuing to access or use our Site after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Site.

10. Entire Agreement

These Terms and our Privacy Policy constitute the sole and entire agreement between you and Power Peptides regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, regarding the Site.
